Summer is in full swing and there is A LOT going on in the filmmaking world behind the scenes. Streamers and studios are cutting spending and reassessing projects. IATSE (International Alliance of Theatrical Stage Employees) is wrapping up negotiations with AMTMP (Alliance of Motion Picture & Television Producers) to avoid a strike. And lawsuits over AI are just ramping up. This last week the criminal trial against Alec Baldwin started (and ended) in New Mexico. Prosecutors claimed that  Baldwin mishandled a gun on set and that he acted recklessly as both an actor and a producer on the set of Rust where he fatally shot and killed Halyna Hutchins, the cinematographer. The armorer and the 1st AD were already found guilty and sentenced. On the third day of trial, it was revealed that prosecutors had hidden bullet evidence from the defense and the judge ordered the case dismissed with prejudice which means that it can't be brought again. See my Legal Take below.

 

Legal Take on the Rust dismissal: Prior to trial the judge had ordered that Baldwin could not be tried in his role as a producer, only as an actor. This case would have had massive implications regarding the responsibilities that actors have to ensure any weapon they use on set is safe. While putting that responsibility on actors may be a bridge too far, the Rust shooting definitely demonstrates that more attention needs to be given to safety standards on set. Consideration of using replica weapons where reasonable not only ensures a safer set but also decreases production and insurance costs.

On another note, the State of New Mexico preliminarily denied Rust's application for tax incentive funds. Yikes.
